Sponsored by: Representative(s) Vranish and Madden A BILL for AN ACT relating to motor vehicle registration; amending county registration fees; providing for reimbursement of lost revenues to counties; requiring a budget request for reimbursement amounts; providing an appropriation; and providing for an effective date . Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 31 ‑ 3 ‑ 101(a)(i)(F), by creating new subparagraphs (G) through (K) and by creating a new subsection (j) is amended to read: 31 ‑ 3 ‑ 101. Registration fees; exemptions . (a) Except as otherwise provided, the following fees shall accompany each application for the registration of a vehicle: (i) A county registration fee computed as follows, or five dollars ($5.00), whichever is greater: (F) 3% of 15% of the factory price plus special equipment value for a vehicle in its sixth year of service ; and thereafter. (G) 3% of 12 % of the factory price plus special equipment value for a vehicle in its seventh year of service; (H) 3% of 9 % of the factory price plus special equipment value for a vehicle in its eighth year of service; (J) 3% of 6 % of the factory price plus special equipment value for a vehicle in its ninth year of service; (K) 3% of 3 % of the factory price plus special equipment value for a vehicle in its tenth year of service and thereafter. (j) On or before February 1, 2014 and not later than February 1 of each subsequent year thereafter, any county may submit a payment request to the state auditor certifying the revenue collected during the prior calendar year pursuant to paragraph (a)(i) of this section and the revenue which would have been collected if paragraph (a)(i) of this section set the county registration fee during a vehicle's sixth year of service and every year thereafter at 3% of 15% of the vehicle's factory price plus special equipment value. After receipt of the payment request , and as soon as practicable while ensuring compliance with this subsection, the state auditor shall transfer to the county the difference between the two (2) amount s certified on the payment request from fund s appropriated for that purpose. In the event that available funds cannot pay all claims made under this subsection, the state auditor shall make payment to all counties submitting claims before the deadline on a pro rata basis according to the total of a county's payment request compared to the total of all payment requests. The state auditor shall prepare a biennial budget request prior to each budget session of the legislature for the purpose of funding the payments anticipated under this subsection and shall submit the request to the governor pursuant to W.S. 9 ‑ 2 ‑ 1010 through 9 ‑ 2 ‑ 1013. Section 2. There is appropriated from the general fund to the state auditor thirty-nine million five hundred dollars ($ 39 ,500,000 .00) . This appropriation shall be expended only for the purpose of making payment to the counties of the amounts requested under this act on or before February 1, 2014. These funds shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation on June 30 , 2014 shall revert pursuant to law. Section 3 . This act shall apply to county registration fees due on or after January 1, 2013. Section 4 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution. (END) 1 HB0069
