Natural gas vehicles.

A BILL

for

AN ACT relating to
motor vehicles;
providing that the department of administration and information may
accept grant applications
for the construction of compressed natural gas filling stations
as specified;
providing for consultation with the Wyoming business council as specified
;
providing grants to
school districts to purchase
buses which
operate on compressed natural gas as specified; providing rulemaking authority; providing appropriations;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

The department of education shall ac
cept applications for grants from
school districts which have
purchased
or will
purchase
within the next sixty (60) days,
buses which operate on compressed natural gas.
Grants shall be issued pursuant to this subsection and rules adopted by the department of education.
Grants
awarded
under this
sub
section
for
a
bus which operates on
compressed
natural gas
shall be the lesser of:

(i)

The difference between the
purchase price of
the

bus
and funds received or to be received by the school district for the purchase of the
bus
pursuant to W.S. 21
‑
13
‑
320; or

(ii)

Ten thousand dollars ($10,000.00).

(b
)

The department of administration and information may
accept grant applications
for the construction of compressed natural
gas filling stations
.

Grants shall be issued pursuant to
this subsection and
rules adopte
d by the department of administration and
information
in consultation with the Wyoming business council
.

The department of administration and information
in consultation with the Wyoming business council
may approve grant application
s
for compressed natural gas filling stations
which meet
the following criteria
:

(i)

Grant applications shall be for
an amount not greater than
the lesser of one-half (1/2) of the total cost of
constructing the compressed natural gas station
or two hundred fifty thousand dollars ($250,000.00)
;

(ii)

T
he
compressed
natural gas filling station
shall be located
in
a county
:

(A)

N
ot served by a compressed
natural gas filling station;
or

(B)

Which has
experience
d
ozone levels which are within nonattainment levels as determined by the department of environmental quality within the last calendar
year;
or

(C)

Which contains at least one (1) school district which has expressed a willingness to convert a portion of its bus fleet to buses which operate on compressed natural gas.

(iii)

Successful grant applications under this subsection shall enter a written agreement with the department of administration and information specifying:

(A)

The price per gasoline gallon equivalent for compressed
natural gas for use in a state or school district
vehicle
s
shall not exceed the lesser of the wholesale cost of compressed natural gas paid by the
compressed natural gas filling station
operating entity plus ten percent (10%) of the price per gasoline gallon equivalent charged to the public. The price per gasoline gallon equivalent for compressed natural gas for use in a state
or school district
vehicle as specified in this
sub
paragraph shall remain in effect until the earlier of:

(I
)

Five (5) years from the date the compressed natural gas filling station becomes operational; or

(II
)

The date on which the dollar amount saved by the state from paying the price per gasoline gallon equivalent of compressed natural gas specified in this
sub
paragraph as compared to the price the
public paid for compressed natural gas during the same time period, equals the
grant amount
.

(B)

T
hat the compressed natural gas filling station shall have both fast fill capacity and slow fill capacity or both; and

(C
)

Any other term and condition the department of administration and information, in consultation with the department of transportation, deems appropriate.

Section 2.

(a)

There is appropriated
two hundred fifty thousand
dollars
($250,000
.00) from the general fund to the
department of education for the purpose of issuing grants
to offset the
purchase
cost of buses which operate on compressed natural gas
under section 1(a) of this act.
Notwithstanding any other

provision of law, this appropriation shall not be

transferred or expended for any other purpose.

nexpended
and
unobligated funds shall revert on June 30, 201
4
.

(b
)

There is appropriated
five hundred thousand dollars ($50
0,000.00) from the general fund to the department of
administration and information
for the purpose of issuing grants
to construct compressed natural gas filling stations
under section
1(b
) of this act. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose. Unexpended and unobligated funds shall revert on June 30, 2014.

Section 3
.

This act is effective July 1, 2012.
