WORKING DRAFT 2012 STATE OF WYOMING 12LSO-0265 HOUSE BILL NO. HB0111 Alcoholic beverages-direct shipment. Sponsored by: Representative(s) Brechtel A BILL for AN ACT relating to alcoholic beverages; providing for direct shipment of alcoholic beverages between in-state manufacturers and importers and retail liquor license holders; provi ding for rules and regulations; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 12 ‑ 2 ‑ 301 by creating a new subsection (f) is amended to read: 12 ‑ 2 ‑ 301. Generally. (f) The commission shall, in accordance with subsection (a) of this section, promulgate rules and regulations authorizing the direct shipment, sale, distribution and receipt of alcoholic liquors between holders of in-state manufacturer ' s and importer's licenses under W.S. 12 ‑ 2 ‑ 203(a) and holders of retail liquor licenses. The rules and regulations shall provide for: (i) Collection of all excise taxes under W.S. 12 ‑ 2 ‑ 302 and markups required under W.S. 12 ‑ 2 ‑ 303 by the holder of the manufacturer’s license; (ii) Payment of the amounts provided in paragraph (i) of this subsection to the liquor commission; and (iii) Record keeping requirements for holders of manufacturer ' s licenses and retail liquor licenses documenting direct shipments. Section 2. This act is effective July 1, 2012. (END) 1 HB0111
