WORKING DRAFT 2012 STATE OF WYOMING 12LSO-0042 HOUSE JOINT RESOLUTION NO. HJ0002 Constitutional assignment of general fines and penalties. Sponsored by: Joint Transportation, Highways and Military Affairs Interim Committee A BILL for A JOINT RESOLUTION proposing to amend the Wyoming Constitution to require that fines and penalties collected under the general laws of the state be applied to the construction or maintenance of Wyoming's roadways. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING, two-thirds of all the members of the two houses, voting separately, concurring therein: Section 1. The following proposal to amend the Wyoming Constitution by creating Article 16, Section 14 and to repeal Wyoming Constitution, Article 7, Section 5 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election: Article 16, Section 14. Fines and penalties dedicated to roadways. All fines and penalties under general laws of the state shall be dedicated to the construction, improvement or maintenance of Wyoming's roadways and be paid to the custodians of such funds which are dedicated to the construction, improvement or maintenance of Wyoming's roadways. Section 2. Article 7, Section 5 is repealed. Section 3 . That the Secretary of State shall endorse the following statement on the proposed amendment: The adoption of the proposed amendment will reassign fine and penalty revenues from the public school fund to funds used for the construction, improvement or maintenance of Wyoming's roadways.
