WORKING DRAFT ORIGINAL SENATE FILE NO. 0022 ENROLLED ACT NO. 4, SENATE SIXTY-FIRST LEGISLATURE OF THE STATE OF WYOMING 2012 BUDGET SESSION AN ACT relating to public health and safety; clar ifying the time for appealing certain agency actions with respect to a clandestine laboratory operation ; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 35 ‑ 9 ‑ 159(e) is amended to read: 35 ‑ 9 ‑ 159. Exceptions to reimbursements; exception to act; clandestine laboratory remediation fund. (e ) If the law enforcement agency denies an extension pursuant to subsection (d) of this section, T he owner may appeal to the district court within sixty (60) days of the issuance of the denial a notice to remediate a clandestine laboratory operation or a denial of an extension under subsection (d) of this section in accordance with W.S. 16 ‑ 3 ‑ 114 of the Administrative Procedure Act . The law enforcement agency's authority to take remediation action shall be stayed while the appeal is pending. Section 2. This act is effective July 1, 2012.
