commercial vehicles and ports of entry;

specifying when
motor carriers
must stop at ports of entry;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Permanent cards and decals; operation without authority; inspections
.

(e)

A
motor carrier
which
has
stopped at a Wyoming port of entry and passed all required inspections

shall not be again required to stop at that port of entry for a period of twenty
-
four (24) hours if:

(i)

No load carried by that motor carrier
during the twenty-four (24) hour period

is more than
three percent (3%)
heavier than the load
initially
checked at the port of entry;

(
i
i)

The motor carrier's main
terminal

and
satellite terminal reside within a ten (10)

m
ile rad
ius of a Wyoming port of entry;

(
i
ii)

The motor carrier's load
s are
loaded or weigh
ed by scales certified by the department of agriculture;

(
i
v)

The motor carrier is making multiple trips to a single location
and not to other locations
within the twenty-four (24) hour period
;
and

(v)

All loads carried by the motor carrier during the twenty-four (24) hour period
are
:

(A)

in the same manner;

)

Comprised of the same
commodity
or payload
.

(f)

Subsection (e) of this section shall not prevent any investigator, trooper or other authorized person from stopping any motor carrier for any purpose permitted by law. Notwithstanding subsection (e) of this section, a motor carrier may be required to return to any port of entry pursuant to W.S. 31

Section 2.

This act is effective July 1, 2012.
