A BILL for AN ACT relating to senior citizen service districts; modifying mill levy imposition election requirements for those districts to every four (4) years; providing for four (4) year terms for district trustees; modifying authorized expenditures of funds; providing for staggering of terms; providing for application to existing districts; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 18 ‑ 15 ‑ 102 (d), 18 ‑ 15 ‑ 105(b), 18 ‑ 15 ‑ 106(a) and 18 ‑ 15 ‑ 111(b)(intro) and (i) are amended to read: 18 ‑ 15 ‑ 102. Formation of district; mill levy. (d) If the proposition to authorize a mill levy is approved by the qualified electors of the proposed district, the proposition to impose a levy in the same or at a different amount not to exceed two (2) mills, shall be submitted to the resident electors within the proposed district at the first general election held two (2) four (4) years after the election authorizing the district and at each second general election thereafter, until defeated. If the proposition to impose or continue a mill levy is defeated, the proposition shall not be submitted to the electors for a period of not less than one (1) year. 18 ‑ 15 ‑ 105. Election of trustees; generally. (b) Members of the board shall be elected at the general election immediately following the primary election establishing the district . a nd At the first election of board members two (2) members shall be elected for an initial term of two (2) years and three (3) members shall be elected for a term of four (4) years. Thereafter board members with expiring terms shall be elected for four (4) year terms a t each the general election , thereafter, until the proposition establishing the district is defeated. 18 ‑ 15 ‑ 106. Candidates to file petition; printing names of candidates on ballot; publication of names. (a) Candidates for the office of special district trustee shall file an application in the office of the county clerk in substantially the following form: APPLICATION FOR ELECTION FOR SENIOR CITIZEN SERVE DISTRICT TRUSTEE I, the undersigned, certify that I was born on ...., (year); and that I have been a resident of the State of Wyoming since ....; that I am a registered voter of the .... senior citizen service district and I do hereby request that my name, ...., be printed on the ballot of the election to be held on the .... day of ...., (year), as a candidate for the office of .... for a term of two (2) or four (4) years (for initial terms, and thereafter for four (4) year terms) . I hereby declare that if I am elected, I will qualify for the office. Dated: .... .... (Signature of Candidate) .... (Residence Address) 18 ‑ 15 ‑ 111. Fund; disposition of revenue; contract requirements. (b) The district may provide directly or shall contract for the provision of senior citizen programs. Contracts for the provision of senior citizen programs shall be with entities meeting the definition of "eligible senior center" under W.S. 9 ‑ 2 ‑ 1201(a)(iii) or other nonprofit entities which provide solely senior citizen programs, and shall be for the provision of services within the district . The contracts shall : (i) Require the provider , if an organization or agency, to be incorporated under the laws of this state as a nonprofit corporation prior to the receipt of any funds; Section 2. Notwithstanding section 1 of this act, for senior citizen service districts in existence as of the effective date of this act the proposition for the continued imposition of a mill levy for the district and election of its trustees shall be submitted at the 2012 general election . Board members shall be elected for staggered terms as provided in W.S. 18 ‑ 15 ‑ 105(b), as amended by this act. Elections for such districts shall thereafter be held in accordance with W.S. 18 ‑ 15 ‑ 101 through 18 ‑ 15 ‑ 111, as amended by this act . Section 3. This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution. (END) 1 SF0088
