WORKING DRAFT 2013 STATE OF WYOMING 13LSO-0097 HOUSE BILL NO. HB0010 Certificates of insurance. Sponsored by: Joint Corporations, Elections and Political Subdivisions Interim Committee A BILL for AN ACT relating to insurance; requiring language to be included in a certificate of insurance; providing definitions; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 26 ‑ 13 ‑ 125 is created to read: 26 ‑ 13 ‑ 125. Certificates of insurance. (a) No person, wherever located, may prepare, issue or knowingly request the issuance of a certificate of insurance regarding a risk located in this state that fails to contain a statement substantially similar to the following: " This certificate of insurance is issued as a matter of information only and confers no right upon the certificate holder. This certificate of insurance does not amend, extend or alter the coverage, terms, exclusions and conditions afforded by an insurance policy referenced in this certificate of insurance. " ( b ) As used in this section : ( i ) " C ertificate " or " certificate of i nsurance " means any document, instrument or questionnaire , regardless of how it is titled or described, that is prepared or issued as evidence of property and casualty insuranc e coverage. " Certificate " or " certificate of i nsurance " : (A) Shall not include a policy of insurance, a certificate issued to a policyholder under a group insurance product, an insurance binder, policy endorsement or automobile insurance identification card; (B) Does not affirmatively or negatively amend, extend or alter the coverage afforded by an insurance policy to which a certificate of insurance refers; (C) Shall not confer to a certificate holder a right that is not provided by an insurance policy to which the certificate of insurance refers; and (D) Shall not refer to a contract that is not an insurance policy, including a construction or service contract. (i i ) " Certificate holder " means a person who: (A) Requests, obtains or possesses a certificate of insurance; and (B) Is not a policyholder. Section 2. This act is effective J uly 1, 2013 .
