Subject: Suspension of certain requirements of the Environmental Quality Act for small mining operations. Summary/Major Elements: Currently, a small mining operation is exempt from certain permitting requirements contained in the Environmental Quality Act if the mining operation will remove 10,000 yards of overburden a year, or less, and affect 10 acres or less a year. This act increases the amount of overburden which can be removed in a given year to 35,000 yards, excluding topsoil, under the small mining operation exemptions. Specifies that roads used to access the small mining operation are not to be considered affected land for the purposes of the 10 acres of affected land exemption.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0055 ENROLLED ACT NO. 104, HOUSE OF REPRESENTATIVES SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2013 GENERAL SESSION AN ACT relating to environmental quality; a mending the criteria for the environmental quality council to modify or suspend certain requirements for specified small surface mining operations; exempting access roads from small surface mine acreage limits; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1 . W.S . 35 ‑ 11 ‑ 401(j) is amended to read: 35 ‑ 11 ‑ 401. Compliance generally; exceptions. (j) The council, upon recommendation from the advisory board through the administrator and director, may modify or suspend certain requirements of W.S. 35 ‑ 11 ‑ 406(a), (b), (d), (f) and (g) by rules and regulations, for surface mining operations involving not more than ten thousand (10,000) thirty-five thousand (35,000) yards of overburden , excluding topsoil, and ten (10) acres of affected land in any one (1) year, if the application requirements insure reclamation in accordance with the purposes of this act. Roads used to access a mining operation permitted under this section shall be excluded from the annual ten (10) acres of affected land limit, but shall be included in the permit and bonded for reclamation liability. Section 2 . This act is effective July 1, 2013.
