Subject: Clarifies employer liability to pay for accrued vacation. Summary/Major Elements: Current law at W.S. 27-4-501 through 508 authorizes the department of workforce services to determine and collect claims for unpaid wages on behalf of employees. This act amends the definition of wages to exclude the value of vacation leave accrued at the time of an employees termination if the employers written policies provide for forfeiture of accrued vacation upon termination and if those policies are acknowledged in writing by the employee.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0079 ENROLLED ACT NO. 37, HOUSE OF REPRESENTATIVES SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2013 GENERAL SESSION AN ACT relating to the collection of unpaid wages; amending the definition of unpaid wages to exclude the value of accrued vacation as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 27 ‑ 4 ‑ 501(a)(iii) is amended to read: 27 ‑ 4 ‑ 501. Definitions. (a) Whenever used in this act: (iii) "Wages" means compensation, including fringe benefits, for labor or services rendered by an employee, whether the amount is determined on a time, task, piece, commission, or other basis , but does not include the value of vacation leave accrued at the date of termination if the written policies of the employer provide that accrued vacation is forfeited upon termination of employment and the written policies are acknowledged in writing by the employee ; Section 2. This act is effective July 1, 2013.
