Subject: Limits use of involuntary detention proceedings for children. Summary/Major Elements: This act: Provides that Title 25 provisions for the emergency detention of mentally ill persons shall be used for children only if the parent or guardian consents to treatment. Provides that the Department of Health, in proceedings for the involuntary hospitalization of a person who is a minor, shall consult with the minors parents or guardian to the extent feasible.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0102 ENROLLED ACT NO. 93, HOUSE OF REPRESENTATIVES SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2013 GENERAL SESSION AN ACT relating to emergency detention and involuntary hospitalization proceedings; providing that emergency detention proceedings involving minor children be brought under the Child Protection Act, as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 25 ‑ 10 ‑ 109(f) and 25 ‑ 10 ‑ 110 by creating a new subsection (o) are amended to read: 25 ‑ 10 ‑ 109. Emergency detention. (f) When a person is detained under emergency circumstances, treatment may be given during the emergency detention period if the person voluntarily and knowingly consents. The parent or guardian of a minor or incompetent person may consent to treatment. If the parent or guardian of a minor patient does not consent to treatment, a petition may be filed under the Child Protection Act. Treatment may be given without the consent of the detained person or his parent or guardian when treatment is limited to diagnosis or evaluation or when treatment is necessary to prevent immediate and serious physical harm to the person or others. Prior to treatment, the person shall be fully advised of the scope of treatment, and a report of the treatment shall be filed with the court if involuntary hospitalization proceedings are commenced. An examiner or a physician who provides treatment in good faith pursuant to this subsection shall be immune from civil liability for the treatment except there shall be no immunity from liability for negligent acts or deliberate misconduct. 25 ‑ 10 ‑ 110. Involuntary hospitalization proceedings. (o) In proceedings under this section involving a minor, the department shall, to the extent feasible, consult with the minor's parents or legal guardian. Section 2. This act is effective July 1, 2013.
