WORKING DRAFT 2013 STATE OF WYOMING 13LSO-0242 HOUSE BILL NO. HB0106 Conservation easements. Sponsored by: Representative(s) Semlek, Davison, Eklund, Jaggi , Teeters and Wallis and Senator(s) Bebout and Geis A BILL for AN ACT relating to conservation easements; providing that no state funds shall be used in the creation of conservation easements; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 9 ‑ 15 ‑ 103 (d)(ii) and by creating a new subsection (n) and 34 ‑ 1 ‑ 202 by creating a new subsection ( f ) are amended to read: 9 ‑ 15 ‑ 103. Wyoming wildlife and natural resource trust account created; income account created; expenditures; purposes. (d) The board may expend funds from the income account for staffing and other administrative expenses authorized under this act. Additional disbursements from the income account shall be for the following purposes: (ii) Preservation of open spaces by purchase or acquisition of development rights as limited by subsection (n) of this section ; (n) No funds shall be disbursed under this act for the creation of a ny conservation easement. 34 ‑ 1 ‑ 202. Creation; conveyance; acceptance and duration. ( f ) Notwithstanding any other provision of law, n o conservation easement shall be created or assigned if state funds are used in the creation or assignment of that easement . Section 2. This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution. (END) 1 HB0106
