AN ACT relating to
trade and commerce; prohibiting filling of liquefied petroleum gas containers without the owner

s permission; providing for marking of liquefied petroleum gas containers; providing penalties; providing a definition;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

Identification of containers; unlawful filling
; unlawful sales and use; penalties.

(a)

If a liquefied petroleum gas container bears on the surface in plainly legible characters the name, mark, initials or other identifying evidence of the owner of the container, it
is
unlawful for any person except the owner or a person authorized in writing by him to:

(
i
)

Fill or refill the container with liquefied petroleum gas or any other gas or compound;

(ii)

Buy, sell, offer for sale, give, take, loan, deliver or permit to be delivered, or otherwise use, dispose of or traffic in any such container; or

(iii)

Deface, erase, obliterate, cover up or otherwise remove, conceal or change any name, mark, initials or other identifying evidence on the container.

(b)

It is unlawful for any person to place the name, mark, initials or other identifying evidence of any person other than the owner of any liquefied petroleum gas container on a liquefied petroleum gas container.

It is unlawful for any person to fill or refill
a liquefied petroleum gas container which is not marked as to
ownership as provided in subsection (a) of this section, i
f the owner of
the
container

notifies
that
person in writing that he is the owner of the container and objects to that person filling or refilling the container.

(d)

Nothing in this section shall make it unlawful for a manufacturer or supplier to place the name of the manufacturer or supplier or other markings required by law on a liquefied petroleum gas container.

(e)

A violation of this section is a misdemeanor punishable by a fine of not more than seven hundred fifty dollars ($750.00), imprisonment for not more than six (6) months, or both.

For purposes of this
section

liquefied petroleum gas
"
means as defined in W.S. 40

This act is effective July 1, 2013.
