Summary/Major Elements: Wyoming currently does not have a cooperative interstate shipment program for a meat and poultry program as allowed by the United States Department of Agriculture (USDA). This program provides states with the authority to set up a system that allows smaller producers to ship meat and poultry across states lines without meeting some of the more burdensome requirements imposed upon larger producers with full USDA approval. This Act requires the Wyoming Department of Agriculture identify the steps required for Wyomings participation in a cooperative interstate shipment program for meat and poultry as allowed under USDA law and rule and regulation for businesses with twenty-five (25) or fewer employees. The Act also requires the state Department of Agriculture identify participants eligible for program participation. Comments: Report required: Not later than October 15, 2013, the Department of Agriculture to report to the Joint Agriculture, State and Public Lands and Water Resources Interim Committee regarding recommendations concerning the establishment of the program.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0109 ENROLLED ACT NO. 69, HOUSE OF REPRESENTATIVES SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2013 GENERAL SESSION AN ACT relating to interstate shipment of meat and poultry; requiring the department of agriculture to conduct a review on the creation of a cooperative interstate shipment program for meat and poultry and identify standards for the program; requiring a report; and providing for an effective date . Be It Enacted by the Legislature of the State of Wyoming: Section 1. (a) The Wyoming department of agriculture shall immediately under take a review of and identification of those acts necessary to participate in a cooperative interstate shipment program for meat and poultry with the United States department of agriculture as established under federal law 21 U.S.C . 683(b) and federal rules and regulation 9 C.F.R. p arts 321, 332 and 381 and in accordance with this act . (b) To promote small, state inspected businesses with twenty-five (25) or fewer employees and allow the sale of meat products across state lines, t he Wyoming department of agriculture shall identify small state-inspected establishments which are able to demonstrate that the y could m e et minimum requirements of a cooperative interstate shipment program. (c) The Wyoming department of agriculture shall identify application procedures for small, state inspected businesses with twenty-five (25) or fewer employees necessary for operation o f and participation in the pro gram. (d) Not later than October 15, 2013, the d epartment shall report to the joint agriculture, state and public lands and water resources interim committee on the results of the review, including its recommendation as to the establishment of a cooperative interstate shipment program for meat and poultry with the United States department of agriculture as required by this act . The report shall include identification of any additional resources necessary for operation of a program and statutory changes necessary for proper implementation and administration of a program . Section 2. This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution .
