WORKING DRAFT 2013 STATE OF WYOMING 13LSO-0468 HOUSE BILL NO. HB0167 Judicial retirement age. Sponsored by: Representative(s) Nicholas, B., Greear, Krone, Stubson and Zwonitzer, Dn. A BILL for AN ACT relating to judicial retirement; modifying mandatory retirement age for supreme court and district court judges; imposing a mandatory retirement age upon circuit court judges; making the act contingent upon passage of a constitutional amendment as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 5 ‑ 1 ‑ 106( a)(intro) and (d) and 5 ‑ 9 ‑ 111 by creating a new subsection (b) are amended to read: 5 ‑ 1 ‑ 106. Retirement of judges of the supreme court or district courts; pension; assignment of retired judges. (a) A judge of the supreme court or district courts shall retire when he attains the age of seventy (70) seventy-five (75) years. A judge is eligible for retirement when he has served as a judge of the supreme court , a district court or both for: (d) The retirement benefit provisions of t his section shall apply to judges who were appointed prior to July 1, 1998 and to judges who have retired and are receiving benefits under this section. Judicial retirement benefits for justices and judges appointed to the bench on or after July 1, 1998 are provided pursuant to W.S. 9 ‑ 3 ‑ 701 through 9 ‑ 3 ‑ 713. 5 ‑ 9 ‑ 111. Qualifications. (b) A judge of a circuit court shall retire when he attains the age of seventy-five (7 5 ) years. Section 2. This act is effective only if the electors adopt a constitutional amendment at the 201 4 general election modifying the mandatory retirement age for justices and judges, as provided i n 2013 House Joint Resolution 1 . Section 3. Subject to section 2 of this act, this act is effective upon certification of the election results of the 2014 election. (END) 1 HB0167
