A BILL

for

AN ACT relating to the Hathaway student scholarship program; establishing a reporting system for honor Hathaway recipients receiving postsecondary remedial education; requiring payment of tuition costs by school districts; authorizing loans as specified; and providing for an effective date.

Payments to a district under this subsection shall be in addition to amounts paid under subsections (b) and (c) of this section and
made
in the school year immediately following the school year in which paid, shall be withheld from the district's foundation program amount computed under W.S. 21

Definitions.

(a)

As used in this article:

(xx)

"Remedial education course" means a course offered by an institution for which successful completion does not count as credit towards a degree or certificate awarded by that institution, and is offered to students lacking skills necessary to perform at the level required for that course by the institution.

(f)

For each academic semester, the University of Wyoming and each Wyoming community college shall maintain a list of students receiving the honor scholarship under this article who are enrolled in a remedial education course at the institution. For each reported student receiv
ing the honor
scholarship enrolling in a remedial education course, the reporting institution shall identify the Wyoming school
district from which the student graduated from high school. Within forty-five (45) days after each academic semester commences, the university and each college shall report to each applicable school district the number of students receiving the honor scholarship under this article who graduated from a high school within that district and are enrolled in remedial education courses during that academic term at that institution. The institution shall also report to the district the total costs of tuition for providing remedial instruction to all reported students from that district. Upon verification of reported numbers of resident students enrolled in remedial education courses during any academic term, the school district of residence shall pay the
remedial instruction
tuition costs associated with resident students to the appropriate institution. Payment by each applicable school district under this subsection shall be made to each reporting institution not later than seventy-five (75) days after the institution's academic term has commenced. If any payment differs from the amount actually due an institution, the excess or deficient amount shall be deducted from or added to the next payment made under this subsection. For purposes of this subsection, payments due for any summer term shall be included within the computations and payments for the
subsequent fall academic term. The university or any community college reporting and receiving payment under this subsection shall not directly assess and collect any
remedial instruction
tuition from a reported resident student enrolled in a remedial education program at that institution.
