WORKING DRAFT 2013 STATE OF WYOMING 13LSO-0575.E1 HOUSE BILL NO. HB0224 State miners' hospital-eligibility. Sponsored by: Representative(s) Miller and Baker and Senator(s) Bebout, Cooper and Hastert A BILL for AN ACT relating to the state miners' hospital; limiting eligibility for services through the state miners' hospital; providing for rulemaking; amending definitions; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 30 ‑ 6 ‑ 102(b)(i), (e)(i) and (ii) is amended to read: 30 ‑ 6 ‑ 102. Account created; expenditures; report. (b) The board shall: (i) Serve disabled or incapacitated miners in this state with emphasis on pulmonary/respiratory, hearing loss, cardiac and musculoskeletal and other conditions , of miners as defined by rule and regulation of the board, due to labor in the mining industry for expenses which are not otherwise covered by public or private insurance or other public health care program ; (e) As used in this section: (i) " Coal or other M ine" means an area of land from which minerals are extracted and processed in nonliquid form or, if in liquid form, through an in situ leach process; (ii) "Miner" means a resident of Wyoming who has worked in a mine in this state or a contiguous state who is or was employed full-time in a mining capacity at a coal or other mine or at a processing or conversion facility contiguous to the mine and dependent upon the output of that mine as feedstock . " Miner" shall include the operator of the mine or plant if the operator works on a continuing or irregular basis ; and the mine is: (A) Under the jurisdiction of the state mine inspector or the mines safety health administration; or (B) An in situ leach process mine . Section 2. This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution. (END) 1 HB0224
