Enticement of
a minor
; penalties.

(a)

A person

is guilty of
enticing a minor if
the person
:

(
i
)

K
nowingly entices, lures or orders or attempts to entice, lure or ord
er a minor under the age
of
fif
teen (1
5
) years into any area or structure that is
obscured from or inaccessible to the public or into a motor vehicle
;

(ii)

D
oes not have the
express
or implied permission
of the minor's parent, guardian or other person responsible for the general supervision of the minor;

s eighteen (18) years of age o
r
older;
and

(
iv
)

Is unknown to the minor.

(b)

It is an affirmative defense to a prose
cution under this section that the
person's
actions were reasonable
under the circumstances and
he
did not have any intent to harm the health, safety or welfare of the minor.

Enticement of a minor
is a
felony
punishable by imprisonment for not more than

years
