Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

a)(xx) is amended to read:

Powers and duties.

(a)

The department of health, through the state health officer, or under his direction and supervision, through the other employees of the department, shall have and exercise the following powers and duties:

(xx)

To operate a public health nursing program which may include, but is not limited to, provision of immunizations, evaluation of the need of individuals for nursing home admission or services and the operation of an infant public health nurse home visitation subprogram. The public health nursing program may, where and to the extent appropriate, be administered through or in conjunction with county, municipal
, local
or district health departments
. Where a public health nursing program is administered through or in conjunction with county, municipal, local or district health departments, a county, municipal, local or district health department may request that funding for the state portion of the public health nursing program provided in this
paragraph
be paid directly to the county, municipal, local or district health department. Upon receipt of the request, the department of health shall
, contingent on an agreement between the county, municipal or district health department on a performance contract,
provide funding for the state portion of the public health nursing program provided in this
paragraph
directly to the county, municipal, local or district health departments and the public health nurses shall be employed by and at the direction of the county, municipal, local or district health department
;

Section 2.

The department of health shall conduct a study of the operation of a statewide public health nursing system in Wyoming, as authorized pursuant to W.S. 35
‑
1
‑
240(
a)(xx). The st
udy
shall address ways to improve the efficiency, uniformity and accountability of the public health nursing system. The department shall report the results of the study, including any recommended statutory or budgetary changes, to the joint labor, health and social services interim committee, by October 1, 201
3
.

Section 3.

There
is appropriated one
dollars
($1.00) from the general fund to the department of health. This appropriation shall be for the period beginning with the effective date of this act and ending June 30, 201
5
. This appropriation shall only be expended for the purpose of providing funding to the county, municipal, local or district health departments for public health nursing as provided in this act. Notwithstanding any other provision of law, th
is
appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 201
5
.

4.

(a)

Section

2 and 3 of this act are effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
