A BILL

for

AN ACT relating to
crimes and offenses; creating a civil trespass penalty;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

Criminal trespass; civil trespass; penalties.

)

Notwithstanding any criminal penalties
or civil remedy
which may apply
,
a person who knowingly
enter
s
or remains on or in the land or premises of another person, knowing he is not authorized to do so, or after being
notified
to depart or to not trespass
, is liable for a
civil
penalty not to exceed seven hundred fifty dollars ($750.00)
.
The penalty may be recovered in a civil action and damages shall be assessed by the court. Any action pursuant to this
sub
section shall be initiated by the attorney general or the appropriate county attorney.

For purposes of this subsection, a person is presumed to know that he is not authorized to enter on the land or premises of another if the person travels off of a public road and dire
ctly enters on private rural land without the permission of the owner or person in

of the land unless the person travels directly to a residence or other structure and immediately leaves the
land
or premises if permission to remain is not granted. As used in this subsection, "rural land" means land outside the boundaries of a city, town or platted subdivision.
