Subject: Amending election requirements for creation of water and sewer districts and election of board members. Summary/Major Elements: Under current law, petitions for formation of a water and sewer district are filed in accordance with the Special District Elections Law of 1994. Under that law, the qualified electors vote on the petition. This act provides a new definition of electors and voters to include qualified electors and landowners in the proposed water and sewer district. This act also removes the requirement that board members be taxpaying electors or voters of the district.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0099 ENROLLED ACT NO. 61, SENATE SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2013 GENERAL SESSION AN ACT relating to water and sewer districts; providing that electors and voters include qualified electors and landowners; amending requirements for directors; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 41 ‑ 10 ‑ 101 by creating a new subsection (b), 41 ‑ 10 ‑ 107(d) and 41 ‑ 10 ‑ 112(b) are amended to read: 41 ‑ 10 ‑ 101. Definitions. (b) For purposes of this act and application of the Special District Elections Act of 1994 to this act, the term " electors " or " voters " include qualified electors as defined in W.S. 2 2 ‑ 2 9 ‑ 104(a)(iv) and landowners as defined in W.S. 2 2 ‑ 2 9 ‑ 104(a)(ii). 41 ‑ 10 ‑ 107. Election in connection with establishment. (d) At the formation election the voters shall vote for or against the formation of the district, and for five (5) taxpaying electors of the district, who shall constitute the board of directors of the district, if organized, to serve until the next regular subsequent director election. 41 ‑ 10 ‑ 112. Subsequent elections of members of board of directors of district. (b) District board members shall serve for a term of four (4) years, except that at the first regular subsequent director election following the formation of the district there shall be elected by the voters of the district two (2) members of the board to serve for a term of two (2) years and three (3) members to serve for terms of four (4) years. Thereafter elections shall be held every two (2) years. Each director shall be a taxpaying voter of the district. Section 2. This act is effective July 1, 2013.
