Sponsored by: Senator(s) Johnson and Representative(s) Goggles A BILL for AN ACT relating to operation of motor vehicles; prohibiting use of cell phones by persons operating school district buses; providing exceptions; providing penalties; providing a definition; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 31 ‑ 5 ‑ 238 is created to read: 31-5-238. Use of cell phones by school bus drivers prohibited. (a) N o person shall use a cellular telephone while operating a school bus for a school district organized pursuant to W.S. 21 ‑ 3 ‑ 101, et seq. unless the cellular telephone is specifically designed to allow hands-free operation and is used in a hands-free manner. (b) This section shall not apply to a person who is occupying a legally parked school bus or to a person who is specifically contacting an emergency services agency to inform that agency of an emergency. (c) A person convicted of violating this section is guilty of a misdemeanor punishable by a fine of not more than seven hundred fifty dollars ($750.00) , imprisonment for not more than thirty (30) days, or both. ( d ) As used in this section, "c ellular telephone" means a mobile communication device that uses short-wave analog or digital radio transmissions between the device and a transmitter to permit wireless communications to and from the user of the device.
