motor vehicles; providing an additional penalty for violations resulting in serious bodily injury or death;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

by creating a new subsection (h)
is amended to read:

Violation of provisions to constitute misdemeanor; penalties.

(h)

In addition to any other penalty, if any person is convicted of a moving violation under this act, except
a
conviction under W.S.

233(h), which results in the death or serious bodily injury of another person,
the court may
determine to impose an additional penalty as provided under this subsection. If
a court determines to impose an
additional penalty the person shall be punished by
an additional fine of not more than one thousand dollars ($1,000.00), an additional term of imprisonment for not more than six (6) months, or both
. A
ny additional term of imprisonment
imposed
under this subsection shall not extend the total term of imprisonment
to more than
one (1) year
for any one (1) violation
.
As used in this subsection "serious bodily injury" means as defined in
W.S.

Section 2.

This act is effective July 1, 2013.
