WORKING DRAFT 2013 STATE OF WYOMING 13LSO-0522 SENATE FILE NO. SF0129 Motor vehicle accidents-serious bodily injury. Sponsored by: Senator(s) Landen, Perkins and Peterson and Representative(s) Harvey, Reeder and Walters A BILL for AN ACT relating to motor vehicles; providing an additional penalty for violations resulting in serious bodily injury or death; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 31 ‑ 5 ‑ 1201 by creating a new subsection (h) is amended to read: 31 ‑ 5 ‑ 1201. Violation of provisions to constitute misdemeanor; penalties. (h) In addition to any other penalty, if any person is convicted of a moving violation under this act, except a conviction under W.S. 6 ‑ 2 ‑ 106 or 31 ‑ 5 ‑ 233(h), which results in the death or serious bodily injury of another person, the court may determine to impose an additional penalty as provided under this subsection. If a court determines to impose an additional penalty the person shall be punished by an additional fine of not more than one thousand dollars ($1,000.00), an additional term of imprisonment for not more than six (6) months, or both . A ny additional term of imprisonment imposed under this subsection shall not extend the total term of imprisonment to more than one (1) year for any one (1) violation . As used in this subsection "serious bodily injury" means as defined in W.S. 31 ‑ 5 ‑ 233( h). Section 2. This act is effective July 1, 2013. (END) 1 SF0129
