This act expands the offense of
threatening injury.

Currently, the
law applies to telephone threats. The act expands the law by including other
electronic or written communications.

The act also
expands the offense by including threats of death to the person, the persons
immediate family or to anyone at the school in which the person is an employee
or student as well as to threats of injury to the person, the persons
immediate family or to property of the person.

The act provides a definition of immediate
family for purposes of the offense.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

Telephone calls; unlawful acts; penalties; communicating a threat of bodily injury or death; place of commission of crime.

(b)

A person commits a misdemeanor punishable by imprisonment for not more than one (1) year, a fine of not more than one thousand dollars ($1,000.00), or both, if:

(ii)

He telephones
another

or otherwise
electronically or in writing
communicates with a
person

and threatens to
:

inflict injury or p
hysical harm to the person

or property of any person.

(A)

Inflict death to the person, to the person's immediate family or to anyone at the school in which the person is a student or employee; or

(B)

Inflict injury or physical harm to the person,
to
the person's immediate family or
to
property of the person.

(c)

A crime under this section is committed at the place where the calls
or other
electronic or written
communications
either originated or were received.
(d)

For purposes of this section, "immediate family" means a spouse, parent, sibling, child or other person living in the person's household.

Section 2.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
