Elements:

The bill creates a felony offense of unlawful entry into
an occupied structure. Under the new offense, a person is guilty of unlawful
entry into an occupied structure if, without authority, he enters or remains in
an occupied structure and commits or attempts to commit a battery or a domestic
battery.

The offense is punishable by up to 10 years in prison, a
$10,000 fine, or both.

A person is guilty of unlawful entry
into an occupied structure if

(b)

Unlawful entry into an occupied structure
is a felony punishable by imprisonment for not more than ten (10) years, a fine of not more than ten thousand dollars ($10,000.00), or both.

(c)

As used in this section:

"Occupied structure"
means a structure

whether or not a person is actually present:

Where any person lives;
