Subject: Changes the definition of bodily injury and serious bodily injury in Title 6 of the criminal statutes. Summary/Major Elements: Revises the definition of bodily injury to mean: o a cut, abrasion, burn or temporary disfigurement; o physical pain; or o impairment of the function of a bodily member, organ or mental faculty. Revises the definition of serious bodily injury to mean an injury which: o creates a substantial risk of death; o causes severe protracted physical pain; o causes severe disfigurement or protracted loss or impairment of a bodily function; o causes unconsciousness or a concussion resulting in protracted loss or impairment of the function of a bodily member, organ or mental faculty; o causes burns of the 2 nd or 3 rd degree over a significant portion of the body; or o causes a significant fracture or break of a bone.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0009 ENROLLED ACT NO. 8, HOUSE OF REPRESENTATIVES SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2014 BUDGET SESSION AN ACT relating to crimes and offenses ; revising certain definitions relating to bodily injury and serious bodily injury for purposes of title 6 crimes, motor vehicle offenses and for other purposes ; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 6 ‑ 1 ‑ 104(a) (i) and (x) and 31 ‑ 5 ‑ 233(h) (intro) are amended to read: 6 ‑ 1 ‑ 104. Definitions. (a) As used in this act, unless otherwise defined: (i ) " Bodily injury" means : physical pain, illness or any impairment of physical condition; ( A) A cut, abrasion, burn or temporary disfigurement; ( B ) P hysical pain; or (C ) I mpairment of the function of a bodily member, organ or mental faculty. ( x) "Serious bodily injury" means bodily injury which : creates a substantial risk of death or which causes miscarriage, severe disfigurement or protracted loss or impairment of the function of any bodily member or organ; (A ) Creates a s ubstantial risk of death; ( B ) Causes severe protracted physical pain; (C ) Causes severe disfigurement or protracted loss or impairment of a bodily function; ( D ) Causes unconsciousness or a concussion resulting in p rotracted loss or impairment of the fun ction of a bodily member, organ or mental faculty ; (E ) Causes burn s of the second or third degree over a significant portion of the body ; or (F ) Causes a significant fracture or break of a bone. 31 ‑ 5 ‑ 233. Driving or having control of vehicle while under influence of intoxicating liquor or controlled substances; penalties. (h) As used in this subsection , "serious bodily injury" means bodily injury which creates a reasonable likelihood of death or which causes miscarriage or serious permanent disfigurement or protracted loss or impairment of any bodily member or organ as defined in W.S. 6 ‑ 1 ‑ 104(a)(x) . Whoever causes serious bodily injury to another person resulting from the violation of this section shall be punished upon conviction as follows: Section 2. This act is effective July 1, 20 1 4.
