A BILL

for

AN ACT relating to
the military department; creating the armory maintenance account; providing for investment and expenditure of funds in the account; providing criteria for expenditures from the account
, including federal matching funds
; providing a
n
appropriation;
authorizing positions;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

Armory maintenance
account
.

(a)

An account is established which shall be known as the Wyoming military department armory maintenance
account
.

(b)

Monies
for
the
account
shall be transmitted to the state treasurer for credit to the
account
monthly and shall be invested by the state treasurer as authorized under W.S. 9
‑
4
‑
715(a), (d) and (e) in a manner designed to obtain the highest return possible consistent with preservation of the transmitted monies. Income and any interest earned from investment of the
account
shall be
credited monthly
by the state treasurer to the
account
, are continuously appropriated to the military department
and
shall be expended
in accordance with subsection (c)
of
this section.

(c)

All funds in the account, including i
ncome and interest earned from the armory maintenance
account
,
shall be
expended
by the adjutant general subject to the following:

(
i
)

Funds in the account, including appropriations and
interest
earni
ngs, shall be used only to address deferred maintenance in
national guard
armories
;

(ii)

Distributions from the account shall not exceed five hundred thousand dollars ($500,000.00) per state fiscal year, commencing July 1, 2014
, and shall be
expended only t
o the extent
equal or
matching federal funds for deferred armory maintenance are received by the department in the same fiscal year
.

(d)

Notwithstanding W.S. 9

funds in the account
shall not lapse or revert until June 30, 2019.

)

The adjutant general shall promulgate rules and regulations for the administration of the armory maintenance account created by this section.

Section 2.

(a)

There is appropriated two million three hundred thousand dollars
($2,300,000.00)
from the general fund to the military department. This appropriation shall only be expended for the purpose of the armory maintenance account pursuant to W.S. 19
‑
7
‑
207 created by this act. Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose.
This appropriation shall not be included in the department's 2017-2018 standard biennial budget
request
.

(b)

An additional two (2) positions are authorized to the military department for the purposes of this act, contingent upon the availability of federal funds to pay all salary and benefits for those positions.
No state funds shall be used to pay salary
or
benefits for these positions.

Section 3.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
