A BILL

for

AN ACT relating to Medicaid; creating the Medicaid fit program; authorizing expansion of the Medicaid program with limited benefits as specified; providing eligibility criteria for Medicaid clients as specified; providing an appropriation; and providing for an effective date.

Medicaid fit program created.

(a)

There is created the Medicaid fit program within the Medicaid program to provide limited medical assistance to eligible individuals.

(b)

Except as provided in this article, all provisions of the Medicaid program under this chapter shall apply to the Medicaid fit program.

Medicaid fit program; eligibility.

The department shall provide for all persons

described under section 1902(a
)(
10)(A)(
i
)(VIII) of the
S
ocial Security Act, 42 U.S.C. § 1396a(a)(10)(A)(
i
)(VIII),
to be eligible for Medicaid under this article beginning January 1, 2015.

Medicaid fit program; limited benefits.

(a)

Medicaid benefits available under this article shall be more limited than those otherwise available under this chapter, and shall be subject to the following:

(
i
)

Benefits shall be tailored to the population described in W.S. 42
‑

‑
402;

(ii)

Cost sharing shall be set at the maximum level allowable under federal law and regulations, and shall mirror cost sharing in the private insurance market to the extent feasible and appropriate;

(iii)

If greater cost sharing is available, the department shall pursue a demonstration waiver under section 115(a) of the Social Security Act;

(iv)

Benefits shall be benchmarked to, actuarially equivalent to or otherwise similar to a commercial private insurance plan to the extent authorized by
section 1937(b)(1) or
1937(b)(2) of the Social Security Act;

(v)

Different benefit packages may be provided to identifiable groups within the population described in W.S. 42

402 and to different regions of the state.

e program created by this article shall not be administered during any time period in which t
he federal medical assistance percentage, pursuant to 42

U.S.C. § 1396d(y), is less than ninety percent (90%).

Section 2.

There is appropriated one hundred fifty
-
six million seven hundred thousand
dollars
($156,700,000.00) in

federal funds to the department of health. This

appropriation shall be for the period beginning with the

effective date of this act and ending June 30, 201
6
. This

appropriation shall only be expended for the purpose of

Medicaid expansion as provided in this act.

Notwithstanding any other provision of law, this

appropriation shall not be transferred or expended for any

other purpose and any unexpended, unobligated funds

remaining from this appropriation shall revert as provided

by law on June 30, 201
6
.

Section 3.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
