A BILL

for

AN ACT relating to
crimes; removing restriction on the carrying of concealed weapons in primary, secondary and postsecondary schools as specified; providing for the carrying of concealed weapons by permit holders as specified; providing for compliance with federal law on primary and secondary school properties;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

Exceptions for state issued concealed carry permits.

(a)

This section shall be known and may be cited as the
"
Repeal Gun Free Zones in Schools Act
"
.

(b)

Any person at least twenty-one (21) years of age holding a valid concealed carry permit issued by the state of Wyoming under W.S. 6

104(a)(ii) may carry a concealed weapon in the following places:

(i)

Any school, college or professional athletic event whether or not related to firearms;

(ii)

Any elementary or secondary school facility; and

(iii)

Any college or university facility without the written consent of the security service of the college or university.

A public primary or secondary school shall
expel from school a
ny
student who is determined to have brought a
firearm to a school, or to have
possessed a firearm at a school as provided in W.S. 21

In the event of an expulsion for reasons cited in this section, a local

school superintendent may
provid
e
educational services to
a
student in an alternative setting.

)

Schools under the jurisdiction of the state board of education shall
r
eport to
the
division
of criminal investigations

a description of the circumstances surrounding any expulsions imposed under
this section containing the following information:

(i
)

T
he name of the school concerned;

(ii
)

T
he number of students expelled from such school
;

(iii
)

T
he type of firearms concerned.

)

The Wyoming
division
of criminal investigations
shall report
students expelled under subsection (b
)
of this
section
to the
United States
s
ecretary
of education
on an annual basis.

e
)

The superintendent of public instruction shall refer
to the criminal justice or juvenile delinquency system
,
a
ny student who brings a
firearm
as described in subsection (
a
) of this section
to a school
in their district
.

(
f
)

Nothing in this section shall apply to a firearm that is lawfully stored inside a locked vehicle on school property, or if it is for activities approved and authorized by the
local school district and was adopted with
appropriate safeguards to ensure student safety.

)

As used in
this section
,
"

chool
"
means any setting that is under the control and supervision of the local educational agency for the purpose of student activities approved and authorized by the local
district.

o person authorized to carry a concealed weapon pursuant to paragraphs (a)(ii) through (iv) of this section shall carry a concealed firearm into:

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
