Sponsored by: Representative(s) Connolly, Gingery, Nicholas, B., Petroff, Sommers, Throne, Wilson and Zwonitzer, Dn. and Senator(s) Rothfuss A BILL for AN ACT relating to governmental immunity; providing a waiver of governmental immunity for damages caused by a violation of whistleblower statutes for medical facilities; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 1 ‑ 39 ‑ 109 is amended to read: 1 ‑ 39 ‑ 109. Liability; medical facilities. (a) A governmental entity is liable for damages resulting from bodily injury, wrongful death or property damage caused by the negligence of public employees while acting within the scope of their duties in the operation of any public hospital or in providing public outpatient health care. (b) A governmental entity is liable for damages resulting from a violation of W.S. 35 ‑ 2 ‑ 910(b). Section 2. Th is act is effective July 1, 2014 . (END) 1 HB0138
