A BILL

for

AN ACT relating to
public health; creating a joint legislative and executive task force to study the creation of an integrated health information
system
as specified; providing appropriations;
and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

(a)

There is created a task force on a health information
system
consisting of the following members:

(i)

Two
(

) member

of the Wyoming senate, appointed by the president of the senate
,

one
(1)
of

who

shall be designated as cochairman;

(ii)

Two
(

) member
s
of the Wyoming house of representatives, appointed by the speaker of the house
,

one
(1)
of
who

shall be designated as cochairman;

(iii)

Five
(

) members appointed by the governor. The governor's appointees shall be selected as having special expertise to represent the interests of patients, payers, providers
and
purchasers
of health
care
.

(b)

The task force shall be staffed by the legislative service office
and the department of health
. State agencies shall provide information and assistance to the task force as requested.

(c)

The task force shall
:

(i)

S
tudy the creation of an integrated health information
system
in Wyoming
. The task force shall make recommendations that
:

(
A
)

Include specific strategies to measure and
collect data related to health
care safety and quality, utilization, health outcomes and cost
;

(
B
)

Result in usable and comparable information that allows public and private healthcare purchasers
and
consumers to identify and compare health plans, health insurers, healthcare facilities and healthcare providers regarding the provision of safe, cost
effective, high quality health
care services
;

(
C
)

Use and build upon existing data collection standards and methods to establish and maintain the database in a cost effective and efficient manner;

and

(
D
)

Ensure
confidentiality of personal information
as required by the Health Insurance Portability and Accountability Act of 1996, P.L. 104-191, and other proprietary information related to collection and release of data.

(ii)

Study the establishment of a standardized set
of quality measures for health
care providers across the state. The goal shall be to create a uniform approach to quality measurement in order to enhance market transparency. The quality measures shall be based on medical evidence, shall be developed th
rough a process in
which health
care providers participate, and shall be reviewed on at least an annual basis. In addition, the measures shall:

(A)

Include uniform definitions, measures, and forms for submission of data, to the extent possible;

(B)

Seek to avoid increasing the
administrative burden on health
care providers;

(C)

Be initially based on existing quality indicators for physician and hospital services, which are measured and reported publicly by quality measurement organizations;

(D)

Place a priority on measures of healthcare outcomes rather than processes where possible; and

(E)

Incorporate measures for primary care, including preventive services, coronary artery and heart disease, diabetes, asthma, depression and other appropriate measures.

(iii)

Study the
appropriate method of integrating population health measurement and analysis into the integrated health
information
system
database.

(d)

The task force shall submit its recommendations, including proposed legislation with respect to the issues specified in subsection (c) of this section, to the
joint labor, health and social services interim committee
and the governor no later than
November
1, 201
4
. The
joint labor, health and social services interim committee
shall consider the recommendations and develop legislation it deems appropriate for consideration by the legislature in the 201
5

general
session.

(e)

The task force shall exist until December 31, 201
4
. Members of the task force who are not state employees or legislators shall not receive a salary but shall receive reimbursement for mileage and per diem expenses at the rate provided for legislators under W.S. 28
‑

‑
101. Members of the task force who are legislators shall be paid salary, per diem and mileage as provided in W.S. 28
‑
5
‑
101 for their official duties as members of the task force.

(f)

There is appropriated from the general fund:

(i)

Twenty-five
thousand dollars ($
25
,000.00) to the legislative service office for payment of salary, per diem and mileage for legislative task force members;

(ii)

Ten
thousand dollars ($
10
,000.00) to the governor's office for payment of authorized per diem and mileage for nonlegislative task force members.

Section 2.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
