Subject: Court findings necessary for supervised probation for misdemeanor crimes. Summary/Major Elements: This act relates to the type of probation a court imposes for a misdemeanor crime. The bill requires that before a court requires that probation involving a misdemeanor offense be supervised by a probation and parole agent, the court must find that there is a particular need for supervision.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0029 ENROLLED ACT NO. 5, SENATE SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2014 BUDGET SESSION AN ACT relating to criminal procedure; requiring findings for supervised probation of misdemeanant s ; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 7 ‑ 13 ‑ 410(b) is amended to read: 7 ‑ 13 ‑ 410. Notice of probation order; request for probation supervision or report. (b) At the time of granting probation or at any later time, the court may request the department to provide supervision of the probationer. The probation and parole agents will not be required to supervise or report on a person granted probation unless r equested to do so by the court granting probation . T he court shall not request supervised probation for a misdemeanor offense unless the court makes findings showing a particular need for supervision of the offender . Section 2. This act is effective July 1, 2014.
