WORKING DRAFT 2014 STATE OF WYOMING 14LSO-0311 SENATE FILE NO. SF0069 Simulcasting permits. Sponsored by: Senator(s) Schiffer and Representative(s) Walters A BILL for AN ACT relating to simulcasting; requiring submission of agreements between the permittee and the horsemen's association as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 11 ‑ 25 ‑ 102( a)(vii) by creating a new subparagraph (B), by amending and renumbering (B) as (C) and by renumbering (C) and (D) as (D) and (E) is amended to read: 11 ‑ 25 ‑ 102. Definitions. (a) As used in this act: (vii) "Simulcasting" means the sale of pari ‑ mutuel pools electronically transmitted live or historic on interstate or intrastate pari ‑ mutuel events as prescribed by the commission. The commission shall authorize simulcasting subject to the following conditions: (B) Simulcasting may be conducted only if the holder of the permit provides the commission with a fully executed copy of an agreement with the horsemen's association which includes provisions allocating the percentage of the takeout required under W.S. 11-25-105 to purses on live flat track races, simulcasts and historic races run by the permittee ; (B) (C) Simulcasting may be conducted off the permitted premises only if the board of county commissioners of the county in which such simulcasting will be conducted grant grants its approval; (C) (D) No simulcasting may be conducted within one hundred (100) miles of any premises permitted under this act, except that the commission may waive the one hundred (100) mile limitation if the simulcast permit application includes written approval from the permittee whose permitted premises is within the one hundred (100) mile limitation; (D) (E) The commission shall promulgate rules for conducting simulcasting as are reasonably necessary to protect the public interest. Section 2. This act is effective July 1, 2014. (END) 1 SF0069
