WORKING DRAFT 2014 STATE OF WYOMING 14LSO-0273 SENATE FILE NO. SF0072 Burglary. Sponsored by: Senator(s) Case, Burns and Hicks and Representative(s) Kroeker and Walters A BILL for AN ACT relating to crimes and offenses; modifying penalt ies and other provisions relating to the offense of burglary; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 6 ‑ 3 ‑ 301 ( b) and (d) is amended to read: 6 ‑ 3 ‑ 301. Burglary; aggravated burglary; penalties. (b) Except as provided in subsection (c) of this section, burglary is : ( i ) A misdemeanor punishable by imprisonment for not more than one (1) year, a fine of not more than one thousand dollars ($1,000.00), or both if all of the following conditions are met : (A) No theft , or a theft of property with a value of less than one thousand dollars ($1,000.00) , was committed in the course of committing the burglary; (B) No felony was committed in the course of committing the crime of burglary; and (C ) T he building , structure , vehicle or separately secured portion thereof : (I) Was not in fact occupied by any person other than the actor or any person voluntarily accompanying the actor at any time in the course of committing the crime of burglary ; (II) Was not locked at the time of the actor's entry; and (I I I) W as not designed or adapted for overnight accommodation . (ii) If the provisions of paragraph ( i ) of this subsection or subsection (c) of this section are not met , a felony punishable by imprisonment for not more than ten (10) years, a fine of not more than ten thousand dollars ($10,000.00), or both. (d) As used in this section other than in subdivision (b)( i )(C)(I), "in the course of committing the crime" includes the time during which an attempt to commit the crime or in which flight after the attempt or commission occurred. As used in s ubdivision (b)( i )(C)(I) of this section the phrase includes only the time during which the actor enters or remains within the building, structure, vehicle or separately secured portion thereof.
