This act creates an additional exception to the definition of employment for services performed by persons acting in a fiduciary capacity, as personal representatives of estates or trustees of trusts, and receiving reasonable compensation for those services pursuant to the Uniform Trust Code or the Wyoming Probate Code.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0074 ENROLLED ACT NO. 42, SENATE SIXTY-SECOND LEGISLATURE OF THE STATE OF WYOMING 2014 BUDGET SESSION AN ACT relating to unemployment compensation; providing an exception to the definition of employment for certain persons acting as fiduciaries; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 27 ‑ 3 ‑ 104 by creating a new subsection (c) is amended to read: 27 ‑ 3 ‑ 104. "Employment" defined; generally; exceptions. (c) As used in this act, "employment" does not include service performed by a person acting as a fiduciary, as that term is defined in W.S. 4 ‑ 10 ‑ 103(a)(vii), and receiving reasonable compensation for fiduciary services pursuant to the Uniform Trust Code or the Wyoming Probate Code. Section 2. This act is effective July 1, 2014.
