Sponsored by: Senator(s) Scott and Landen and Representative(s) Brown, Greear and Stubson A BILL for AN ACT relating to labor and employment; amending the definition of independent contractor for purposes of unemployment compensation and workers' compensation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 W.S. 27 ‑ 3 ‑ 104(b)(intro), (vi) and by creating new paragraphs (vii) and (viii) and 27 ‑ 14 ‑ 102(a)(xxiii)(intro), (D) and by creating new subparagraphs (E) and (F) are amended to read: 27 ‑ 3 ‑ 104. "Employment" defined; generally; exceptions. (b) An individual who performs service for wages is an employee for purposes of this act unless it is shown that the individual performing the services either : (vi) May substitute another individual to perform his services ; . or (vii) Is free from control or direction , asserted directly by the person or entity contracting for the services, over the details of the performance of services by contract and by fact; and (viii) Has substantial investment used in connection with the performance of the services. The investment may include physical assets, financial assets, education, experience, intellectual property or any combination of these factors. 27 ‑ 14 ‑ 102. Definitions. (a) As used in this act: (xxiii) "Independent contractor" means an individual who performs services for another individual or entity and either : (D) May substitute another person to perform his services ; . or (E) Is free from control or direction , asserted directly by the person or entity contracting for the services, over the details of the performance of services by contract and by fact; and (F) Has substantial investment used in connection with the performance of the services. The investment may include physical assets, financial assets, education, experience, intellectual property or any combination of these factors. Section 2. (a) This act is effective July 1, 2014. (b) This act shall apply to initial claims filed on or after the effective date of this act. (END) 1 SF0096
