A BILL

for

AN ACT relating to special museum districts; specifying the procedure for establishing a special museum district and conducting subsequent district elections; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Establishment of museum districts
.

(e)

A special museum district may be established under the procedures for petitioning, hearing and election of special districts as set
forth in the Special District E
lections Act of 1994
.

or
through the following
process:

(
i
)

A
board of county commissioners may, by resolution, submit
the question of establishing a
special museum district to the electors of the proposed district. The board shall provide notice that it will consider
the
resolution at least thirty (30) days prior to the meeting at which th
e resolution will be considered
;

(ii)

A resolution proposed by a board of county commissioners under paragraph (
i
) of this subsection shall set forth the name of the proposed district, the purpose for which the district is to be formed and a description of the proposed district boundaries;

(
i
ii)

Upon passage of the resolution specified in paragraph (
i
) of this subsection by a majority of the county commissioners elected to the board of county commissioners, the board of county commissioners shall submi
t the question of establishing the
special museum district and the election of
the initial directors

to the electors of the proposed district
at the next general election
. The election and notice thereof shall be
conducted as required by the Specia
l District Election
s
Act of 1994;

(iv
)

If
formation of the special museum district is
approved
during the election specified in paragraph (iii) of this subsection,
the board of county commissioners shall enter that fact upon its record and the district is established;

(v
)

Any subsequent election in
a special museum district created under this subsection shall be held as provided in the Special District Elections Act of 1994.

Section 2
.

This act is effective July 1, 2015.
