A BILL

AN ACT relating to crimes and offenses; prohibiting opening a fence for the purpose of letting livestock on the land of another; providing an exception; providing a penalty; and providing for an effective date.

Neglect to close fences; intentionally opening a fence; penalty

.

(a)

A person is guilty of a misdemeanor punishable by a fine of not more than seven hundred fifty dollars ($750.00) if he opens and neglects to close a gate or
replace bars in a fence
or modifies, destroys or removes any portion of a legal fence

which crosses a private road or a river, stream or ditch.

(b)

A person is guilty of a misdemeanor punishable by a fine of not more than seven hundred fifty dollars ($750.00) if
, without authorization,
he opens a gate or
modifies,
destroys or removes any portion of a legal fence for the purpose of allowing livestock under his ownership or control to enter the land of another
for the consumption of forage
.

(c)

Nothing in this section shall be deemed to prohibit a person from modifying, destroying or removing any portion of a legal fence in an emergency.
