Sponsored by: Representative(s) Zwonitzer, Dn. and Senator(s) Case A BILL for AN ACT relating to boards, commissions or other bodies; requiring appointed members to notify the governor when the member fails to meet or maintain qualifications as specified; providing for removal for failing to meet or maintain qualifications as specified; providing for the governor to fill vacancies as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 9 ‑ 1 ‑ 218 by creating a new subsection (f) is amended to read: 9 ‑ 1 ‑ 218 . Appointment to boards, commissions, or other bodies; appointment districts; requirement; conditions for appointments based on political party affiliation ; removal; vacancies . (f) It shall be the duty of a member of a state board, commission, council or committee appointed by the governor and confirmed by the senate, to notify the governor when he fails to meet or maintain any qualification for which he was appointed, including but not limited to residency or political party affiliation. W hen the governor becomes aware that the member fails to meet or maintain any qualification for which th e member was appointed, whether through notification by the member or through any other means, that m ember shall be automatically removed from the board, commission, council or committee and a vacancy is created. All vacancies created under this subsection shall be filled by appointment by the governor as provided in W.S. 28 ‑ 12 ‑ 101 within thirty (30) days of the vacancy. Section 2 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution . (END) 1 HB0035
