Subject: Portable electronic device insurance claims-unlicensed adjusters. Summ ary/Major Elements: Prior law required that all insurance claim adjusters be licensed. The requirement included adjusters working with small claims related to portable electronic devices, such as cellular telephones. This legislation a llows an unlicensed insurance adjuster to adjust portable electronic device insurance claims when the adjuster is supervised by a licensed adjuster who supervises no more than 25 unlicensed individuals . The legisl ation provides a definition of “ portable el ectronic device insurance claim” as follows: “ portable electronic device insurance claim means a claim filed by an insured or claimant to receive benefits under a portable electronic device insurance contract for an electronic device and its accessories that are portable in nature and which must be easily carried or conveyed by hand. ” The above summary is not an official publication of the Wyoming Legislature and is not an official statement of legislative intent. ORIGINAL House Bill No . HB0040 ENROLLED ACT NO. 12 , HOUSE OF REPRESENTATIVES SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2015 General Session AN ACT relating to insurance; providing a licensure exception for persons collecting or distributing insurance claim information as specified; providing definitions; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 26 ‑ 9 ‑ 219 by creating new subsections (f) and (g) is amended to read: 26 ‑ 9 ‑ 219 . Adjuster ' s license; exception; notification. (f) This section shall not apply to an individual who: (i) Collects claim information from, or furnishes claim information to, insureds or claimants for portable electronic device insurance claims; (ii) Conducts portable electronic device insurance claim data entry, including entering data into an automated claims adjudication system; and (iii) Is supervised by a licensed adjuster, or licensed agent who is exempt from licensure as an adjuster pursuant to W.S. 26 ‑ 1 ‑ 102( a)(i) . The agent or adjuster shall not supervise more than twenty ‑ five (25) persons who are exempted under this subsection. (g) For purposes of subsection (f) of this section: (i) " A utomated claims adjudication system " means a preprogrammed computer system which is designed for the collection, data entry, calculation and initial resolution of portable electronic device insurance claims ; (ii) " Portable electron ic device insurance claim " mean s a claim filed by an insured or claimant to receive benefits under a portable electronic device insurance contract for an electronic device and its accessories that are portable in nature and which must be easily carried or conveyed by hand. Section 2 . This act is effective July 1, 2015 .
