A BILL

for

AN ACT relating to Medicaid; creating a grant program to assist developmental disability service providers or employers in complying with a revised Medicaid waiver program as specified; providing grant criteria; establishing an account; requiring reports; providing an appropriation; and providing for an effective date.

Medicaid waiver transition grants.

(a)

The department of health shall administer a grant program to assist developmental disability service
providers
or employers
in transitioning their service delivery
systems
to conform
to
the requirements of Medicaid waiver programs for children with developmental disabilities, adults with developmental disabilities and persons with acquired brain injuries, as those programs were
redesigned
in 2014.

(b)

Grants
pursuant to this section
shall be subject to the following:

(
i
)

Grants shall be available to service providers
or employers
to implement specific changes that support the comprehensive
and
support
s
waiver programs and meet the community based setting standards of the centers for Medicare and Medicaid services;

(ii)

Grant funds may be used to assist providers
or employers
in
, but not limited to:

(A)

Updating their business plans;

(B)

Implementing person centered planning;

(C)

Implementing community integration services;

(D)

Funding consultants, updating processes
and
training staff on new services;

(E)

Promoting and increasing the variety of living options and employment services being provided to participants as documented in their plans of care.

(iii)

Grants
under this section
shall be awarded for a one (1) year period, and may be renewed
not more than two (2) times f
or additional one (1) year periods.

(c)

The department shall adopt rules and regulations necessary to carry out the purposes of this act. Rules shall be promulgated in sufficient time to enable
awarding of
grants to applicant service providers
or employers
commencing July 1, 2015. Rules shall include provisions relating to:

(
i
)

Grant application procedures;

(ii)

Grant eligibility;

(iii)

Procedures for distribution of grant funds;

(iv)

Grantee
record keeping
,
reporting
and auditing
requirements.

(d)

The comprehensive
and
supports waiver transition account is created. The account shall consist of those funds appropriated to the account by the legislature and all monies received from federal grants and other contributions, grants, gifts, transfers, bequests and donations to the account. The account
may
accept grants, gifts, transfers, bequests and donations. Funds in the account are continuously appropriated to the department for the purpose of providing grants as provided in this section
.

(e)

The department shall report on grants issued under this section to the joint labor, health and social services interim committee on or before October 1, 2015 and by October 1 annually
through 2018
. Reports submitted
under this subsection shall
provide
information for the time period since the submittal of the last report, including:

(
i
)

Total number of grants issued;

(ii)

Total amount of funds contracted;

(iii)

Number of waiver recipients covered under grants awarded under this section;

(iv)

The
nature of the provider
or employer
improvements or changes facilitated by the
grants awarded under this section
; and

(v)

Any other information the department deems necessary
.

Section 2

One
million dollars ($

00,000.00) is appropriated from the general fund to the comprehensive
and
supports waiver transition account as created under section 1 of this act. Of this appropriation, the department shall expend not more than one million dollars ($1,

for grants during the fiscal year beginning July 1, 2015
.

Notwithstanding any other provision of law, this appropriation shall not be transferred or expended for any other purpose and any unexpended, unobligated funds remaining from this appropriation shall revert as provided by law on June 30, 201

. This appropriation shall not be included in the department's 2017
‑
2018 or subsequent standard biennial budget requests.

Section

.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution
