Subject: Amends elements constituting child abuse and increases penalties as specified. Summary/Major Elements: This bill: Adds torture or cruel confinement of child as a basis for child abuse with penalties for child abuse amended as follows: Increases the penalty for intentionally or recklessly inflicting child abuse of a child under the age of 16 by a person who i s not responsible for the child’ s welfare from imprisonment f or not more than 5 years to imprisonment for not more than 10 years; Increases the penalty for intentionally or recklessly inflicting child abuse of a child under the age of 18 by a person w ho is responsible for the child’ s welfare from imprisonment f or not more than 5 years to imprisonment for not more than 10 years; Specifies aggravated child abuse, punishable by imprisonment for not more than 25 years, may include the intentional infliction of substantial mental or emotional injury upon a child by the torture or cruel confinement of the child . ORIGINAL House Bill No . HB0243 ENROLLED ACT NO. 94, HOUSE OF REPRESENTATIVES SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2015 General Session AN ACT relating to crimes and offenses; defining the type of conduct that constitutes child abuse; providing for an increase in penalties as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 6 ‑ 2 ‑ 503( a) (intro) , ( ii)(A) , (B) , by creating a new subparagraph (C), (b) (intro) , ( i ), (ii) , by creating a new paragraph (iii) and (c) is amended to read: 6 ‑ 2 ‑ 503 . Child abuse; penalty. (a) A person who is not responsible for a child' s welfare as defined by W.S. 14 ‑ 3 ‑ 202(a)( i ), is guilty of child abuse, a felony punishable by impr isonment for not more than five (5) ten (10) years , if: (ii) The actor intentionally or recklessly inflicts upon a child under the age of sixteen (16) years: (A) Physic al injury as defined in W.S. 14 ‑ 3 ‑ 202( a)(ii)(B); or (B) Ment al injury as defined in W.S. 14 ‑ 3 ‑ 202( a)(ii)(A) ; . or (C) Torture or cruel confinement . (b) A person is guilty of child abuse, a felony punishable by imprisonment for not more than five (5) ten (10) years, if a person responsible for a child' s welfare as defined in W.S. 14 ‑ 3 ‑ 202( a)( i ) intentionally or recklessly inflicts upon a child under the age of eighteen (18) years: ( i ) Physical injury as defined in W.S. 14 ‑ 3 ‑ 202( a)(ii)(B), excluding reasonable corporal punishment; or (ii) Ment al injury as defined in W.S. 14 ‑ 3 ‑ 202( a)(ii)(A) ; . or (iii) Torture or cruel confinement. (c) Aggravated child abuse is a felony punishable by imprisonment for not more than twenty ‑ five (25) years if in the course of committing the crime of child abuse, as defined in subsection (a) or (b) of this section, the person intentionally or recklessly inflicts serious bodily injury upon the victim or the person intentionally inflicts substantial mental or emotional injury upon the victim by the torture or cruel confinement of the victim . Section 2 . This act is effective July 1, 2015 .
