Subject: Establishment, collection and evidence of aquatic invasive species fees. Summary/Major Elements: Under current law, the G ame and F ish C ommission and the D epartment of S tate P arks and C ultural R esources establish and collect annual fees for the aquatic invasive species program which is evidenced only by a sticker to be applied to every watercraft (not including personal flotation devices or water sport toys) . This bill specifies that only the G ame and F ish C ommission shall establish and collect the annual fees. This bill allows the payment of the annual fee to be evidenced electronically as determined by commission rule or regulation. ORIGINAL Senate File No . SF0006 ENROLLED ACT NO. 13 , SENATE SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2015 General Session AN ACT relating to aquatic invasive species; amending rulemaking authority; amending requirements for collection and evidence of inspection fees; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 23 ‑ 4 ‑ 204(b)(intro) , (b) (i) and (ii) is amended to read: 23 ‑ 4 ‑ 204 . Rulemaking authority; fees. (b) The commission and the department of state parks and cultural resources shall establish and collect fees in accordance with the following: (i) An annual fee shall be collected by the commission or the department of state parks and cultural resources for every watercraft before the watercraft enters the waters of the state. Payment of the fees shall be evidenced by a sticker placed on the bow of the watercraft and or electronically as determined by commission rule or regulation. N o person shall operate nor shall the owner permit the operation of any watercraft on the waters of the state without payment of the fees provided in this section . and display of the sticker on the bow of the watercraft. For purposes of this paragraph, "watercraft" means any contrivance used or designed primarily for navigation on water but does not include personal flotation devices or water sport toys; (ii) Notwithstanding W.S. 23 ‑ 4 ‑ 203(a) and subsection (a) of this section, f ees shall be established by commission rule or regulation promulgated in accordance with the Wyoming Administrative Procedure Act; Section 2 . W.S. 23 ‑ 4 ‑ 204(c) is repealed. Section 3 . This act is effective July 1, 2015 .
