Subject: Method of execution by firing squad Summary/Major Elements: Under current law, the method of execution is by le thal injection with an alternative method of execution , by administration of le thal gas , if lethal injec tion is found unconstitutional. This bill amends the alternative method of execution by replacing lethal gas with a firing squad. The bill also provides the alternative method of execution may be used if the sentencing court finds execution by lethal injection cannot be performed within the time prescribed by law . NOTE: Final action on this bill was not taken at the time this summary was prepared. Should changes be made to the bill upon final passage, an updated summary will be prepared and placed upon the legislative website at www.legisweb.gov . A packet of updated summaries will be sent to all legislators after the time for any veto has expired (fifteen days after adjournment). 2015 STATE OF WYOMING 15LSO-0002 Numbered 2.1 SENATE FILE NO. SF0013 Method of execution-1. Sponsored by: Joint Judiciary Interim Committee A BILL for AN ACT relating to criminal procedure; amending the method of execution of a death sentence; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 7 ‑ 13 ‑ 904( b) is amended to read: 7 ‑ 13 ‑ 904 . Method of execution. (b) If the method of execution of the sentence of death as provided in subsection (a) of this section is held unconstitutional or if the sentencing court finds execution by lethal injection cannot be performed within the time prescribed by law , the sentence of death shall be executed by the administration of lethal gas firing squad within the time prescribed by law unless for cause shown, the court or the governor extends the time. Section 2 . This act is effective July 1, 2015 . (END) 1 [Bill Number]
