A BILL

for

AN ACT relating to theft of identity; increasing the penalty if the victim is a minor and the alleged perpetrator is the parent or legal guardian of the victim; providing a definition authorizing a parent or legal guardian to place a security freeze on the credit report of a minor; and providing for an effective date.

Unauthorized use of personal identifying information; penalties; restitution.

(c)

Theft of identity is:

(i)

Except as otherwise provided in this subsection,
a
misdemeanor punishable by imprisonment for not more than six (6) months, a fine of not more than seven hundred fifty dollars ($750.00), or both, if no economic benefit was gained or was attempted to be gained, or if an economic benefit of less than one thousand dollars ($1,000.00) was gained or was attempted to be gained by the defendant;
or

(ii)

A felony punishable by imprisonment for not more than ten (10) years, a fine of not more than ten thousand dollars ($10,000.00), or both, if an economic benefit of one thousand dollars ($1,000.00) or more was gained or was attempted to be gained by the defendant

or
regardless of any economic benefit
if the victim is less than eighteen (18) years of age and the
person
violating this section
is the victim's parent or legal guardian.

(h)

As used in this section, "consumer" includes the parent or legal guardian of a person less than eighteen (18) years of age.
