mmary/Major Elements:

Vacancies in the U.S. House of Representatives are filled by special election. Under current law, the special election must be held 55 days after the vacancy occurs.

Under the
federal
Military and Overseas Voter Empowerment Act
(MOVE Act), special election ballots have to be mailed 45 days before the election.
The current 55-
day time limit for the special election makes it difficult or impossible to comply with the MOVE Act.

This legislation extends the time limit for holding a special election to 89 days after the vacancy occurs.

This time limit is designed to allow all the processes necessary to conduct a special election to occur prior to the MOVE Act deadline. Other related time limits are amended.

This legislation also amends the statute related to the computation of periods of time to specify how Saturdays, Sundays and legal holidays are treated.

Computing periods of time.

(a)

Except for special elections

eriods of time are computed by excluding the specific day and counting the prescribed number of days, including Saturdays, Sundays and full legal holidays. If the first day of a time period falls on a Saturday, Sunday or full legal holiday, the preceding day which is not a Saturday, Sunday or full legal holiday shall be used. If the last day of a time period falls on a Saturday, Sunday or full legal holiday, the next day which is not a Saturday, Sunday or full legal holiday shall be used.

An elector qualified to hold the office of representative in congress shall be nominated by the state central committee of the respective parties to fill a vacancy for the unexpired term of that office. Nominations from such parties shall be filed with the secretary of state and fees paid within

A special election to fill a vacancy shall be conducted by the county clerk as nearly as possible in the manner of a general election.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
