A BILL

AN ACT relating to alcoholic beverages; prohibiting use, purchase, sale, solicitation and possession of powdered alcohol as specified; providing penalties; providing exceptions; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Powdered alcohol; prohibition; penalties; exceptions.

(
a
)

It shall be unlawful for a person to use, offer for use, purchase, offer to purchase, sell, offer to sell or possess powdered alcohol.

(
b
)

Any person violating this section is guilty of a misdemeanor and upon conviction may be punished as follows:

(i)

For a first offense, by a fine of not more than three hundred dollars
($300.00),
imprisonment for not more than thirty
(30)
days, or both;

(
ii
)

F
or a
ny subsequent
offense, by a fine of not more than seven hundred fifty dollars
($750.00),
imprisonment for not more than six
(6)
months, or both
.

(c)

As used in this section, "powdered alcohol" means ethyl alcohol prepared or sold in a powder or crystalline form for either direct use or reconstitution.

This section does not apply to the use of powdered alcohol for
legal
commercial uses or bona fide research purposes by:

(
i
)

A
health care provider
who

uses powdered alcohol
for the purpose of conducting scientific research;

(
ii
)

A s
tate institution;

(
iii
)

The University of Wyoming, a
Wyoming
community college or a
private college or university; or

(
iv
)

A
pharmaceutical or biotechnology company.
