Subject: Authorizes hospice facilities to provide short-term respite care. Summary/Major Elements: The Department of Health licenses health care facilities, including hospice facilities. This act amends the definition of hospice facilities to allow short-term respite care for non-hospice pa tients, as long as the facility’ s primary activity remains the care of terminally ill individuals, and the respite care is not paid for by any governmental third party payment program. SF0119 ENROLLED ACT NO. 43, SENATE SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2015 General Session AN ACT relating to health care facility licensing; authorizing hospice facilities to provide short term respite care as specified; and providing for an effective date. Be It Ena cted by the Legislature of the State of Wyoming: Section 1 . W.S. 35 ‑ 2 ‑ 9 01(a)(xii) is amended to read: 35 ‑ 2 ‑ 901 . Definitions; applicability of provisions. (a) As used in this act: (xii) "Hospice" means a program of care for the terminally ill and their families given in a home or health facility which provides medical, palliative, psychological, spiritual and supportive care and treatment . Hospice care may include short ‑ term respite care for non ‑ hospice patients, if the primary activity of the hospice is the provision of hospice services to terminally ill individuals and provided that the respite care is paid by the patient or by a private third party payor and not through any governmental third party payment program ; Section 2 . This act is effective July 1, 2015 .
