A BILL

for

AN ACT relating to the administration of government; creating the Vision 2020 comprehensive expenditure and revenue review; providing for oversight of the review by the management council of the Wyoming legislature; creating the Vision 2020 comprehensive expenditure and revenue review advisory panel; creating areas of review; providing for the creation of task forces as specified; providing for appointment of members to the advisory panel and task forces; providing for assignment of duties as specified; providing for reports; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1
.

(a)

There
is
created the
Vision 2020
comprehensive expenditure and revenue review.
The management council of the Wyoming legislature shall
oversee the comprehensive expenditure and revenue review.
Not later than May 1, 2015, the management council, in consultation with the
Vision 2020
comprehensive expenditure and revenue review advisory panel created in subsection (b) of this section
, shall assign the responsibility for reviewing state expenditures, revenues, tax e
xemptions and permanent and non
permanent savings to either a joint interim committee of the Wyoming legislature, the joint appropriations committee or task
force
s
created by management council under this act.

(b)

There is created the
Vision 2020
comprehensive expenditure and revenue review advisory panel consisting of the
current
governor,
the
speaker of the house of representatives,
the
president of the senate, all living former Wyoming governors wishing to participate
and
current
and former joint appropriations committee chairmen
wishing to participate
,
who served as chairman of
the committee
on or after January 1, 199
0
. The advisory panel shall:

(i)

Be co-chaired by the
current
governor and
the
president
of the senate
;

(ii)

Be consulted for
recommendations
,
advice
and peer review functions
regarding the ex
amination directed in paragraph
(
d
)(vii) of this section
or such other parts of this act as requested by management council
; and

(iii)

For all members of the
Vision 2020 comprehensive expenditure and revenue review
advisory panel, other than the governor, be paid the same salary, per diem and mileage
as members of the legislature

traveling to and from meetings or
while in actual attendance at meetings of the
advisory panel
and
during
the perfo
rmance of their duties relative
thereto as if the
advisory panel
was an interim committee of the legislature
.

(c)

The management council of the Wyoming legislature shall establish such
task forces
as it deems necessary
to complete the
Vision 2020
review
and may make appointments from members of the legislature, executive branch personnel f
rom Wyoming state government and
members of the Wyoming public. In making appointments
to the task forces
, the management council shall apportion the legislative membership
of each task force
as nearly as possible to reflect the percentage of the elected membership of the majority and minority parties of the full legislature and shall appoint at least one (1) member from each
major
party
of
each house
of the legislature
to each established
task force
.

(
d
)

In making
assignments
of duties under subsection (a) of this section,
the management council, in consultation with the
Vision 2020
advisory panel
:

(i)

Shall apportion the work among the
task forces

and committees
as equally as possible;

(ii)

Is not required to make assignments based upon the traditional subject matter jurisdiction of the
joint interim
committee;

(iii)

Shall notify all legislators of assignments made to each committee
or task force
;

(iv)

Shall
provide for a comprehensive review of total state expenditures, including emphasis on those agencies or programs identified by management council as having the highest rate of growth over the last decade;

(v)

Shall provide for a comprehensive review of total state revenues and an evaluation of major revenue streams;

(vi)

Shall
provide for an examination of statutory tax exemptions, with
an
emphasis on tax exemptions requiring an appropriation of state funds;

(vii)

Shall provide for a comprehensive examination of additional or alternative sources of revenue or revenue streams to the state;

(viii)

Shall provide for a comprehensive examination of all
statutorily
mandated cost-of-living adjustments, escalators or other mechanism
s
which increase expenditures without budgetary authority or review; and

(
i
x
)

Shall provide for an e
xamination of permanent and non
permanent reserve account balances of the
state
and make recommendations for statutory changes
in recognition of the state
'
s revenue volatility
,
regarding:

(A)

The level of permanent and non
permanent reserve accounts including but not limited to the legislative stabilization reserve account created by 2005 Wyoming Session Laws, Chapter 1
91, Section 4, Section 301(d),
the strategic investments and projects account created by 2013 Wyoming Session Laws, Chapter 73, Section 300(e), the school foundation program reserve account created by 2014 Wyoming Session Laws, Chapter 26, Section
300(g) and the permanent land fund holding account created by 2012 Wyoming Session Laws, Chapter 16, Section 1(j)(iv);

(B)

The identification of revenue
sources
to achieve the recomme
nded level of permanent and non
permanent savings; and

(C)

Policy criteria
to guide the withdrawal of non
permanent savings.

(
e
)

Legislative members of a task force created pursuant to subsection (c) of this section shall receive salary, per diem and mileage for traveling to and from and attending meetings of the committees as if the task force was an interim committee of the legislature. Members of the public appointed to a task force who are not employed by the state,
shall receive the same per diem, expenses and travel allowance as
legislative
members of the
task force.

)

The

Vision 2020
advisory panel
and a
ll committees
or task forces
appointed by
the
management council shall be staffed by the legislative service office.
E
xecutive
branch agencies shall provide assistance to the committees
, task forces
and advisory panel upon request.

(
g
)

The m
anagement council may engage the services of research
firms, consulting expertise or U
niversity of Wyoming personnel as necessary to carry out the purposes of this act.

(
h
)

Not later than October 1, 2015, each committee
or task force
assigned a task by management council under subsection (
a
) of this section shall submit a
report
of
its
preliminary findings to the governor, management council and
the
Vision 2020
advisory panel.

(
j
)

Not later than September 1, 2016, each committee
or task force
assigned a task by management council under subsection (
a
)
of this section
shall submit its final
report,
findings, policy recommendations and recommended statutory change
s in draft form to the
management council and
the
Vision 2020
advisory
panel
. The management council shall consolidate the
reports
, make final recommendations to the legislature, state elected officials and any
impacted state agency or institution and propose statutory changes required to implement its recommendations not later than November 15, 2016.

Section 2
.

There is appropriated
three
hundred fifty thousand dollars ($
3
50,000.00) from the general fund to the legislative service office to carry out the purposes of this act.

any unobligated, unexpended funds remaining in this appropriation shall revert to the general fund on June 30, 2017.

Section 3
.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
