Subject: Water quality issues related to diversion of water. Summary/Major Elements: Existing law specifies water quality standards for the purposes of the Wyoming Environmental Quality Act. This bill provides the provisions of the E nvironmental Q uality A ct shall not be interpreted to supersede or abrogate a valid water right. The bill provides it is recognized that a diversion of water caused by the exercise of a valid water right is an allowable practice. The bill requires the administrator of the W ater Q uality D ivision to develop water quality standards where the exercise of valid water rights or the diversion or hydrologic modification precludes attainment of any existing water quality standard. ORIGINAL Senate File No . SF0126 ENROLLED ACT NO. 75, SENATE SIXTY-THIRD LEGISLATURE OF THE STATE OF WYOMING 2015 General Session AN ACT relating to water quality; requiring development of water quality standards as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1 . W.S. 35 ‑ 11 ‑ 302 by creating a new subsection (c) is amended to read: 35 ‑ 11 ‑ 302 . Administrator's authority to recommend standards, rules, regulations or permits. (c) Nothing in this act shall be construed to supersede or abrogate any valid water right. It is recognized that diversion of water caused by the exercise of a valid water right is an allowable practice. The administrator shall: ( i ) Develop water quality standards for surface waters where hydrologic modification resulting from the exercise of valid water rights precludes the attainment of existing water quality standards; (ii) Prepare a schedule to develop appropriate water quality standards based on the completion of a use attainability analysis for any waters that have been identified pursuant to 33 U.S.C. § 1315(b) where dams, diversions or other types of hydrologic modification preclude the attainment of any existing water quality standard. Section 2. This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of th e Wyoming Constitution.
